Version 9.0

Hello

These are the terms of use for this website. They tell you:

• The rules for using our services;

• What you can do with our content (sharing, linking to it, that sort of thing);

• What we can do with things you post or upload;

• Your rights and responsibilities, basically important stuff.

We’ve kept them as short and clear as possible.
So do read them, and check in for updates as the latest version always applies.

When these terms apply

• Read these terms before using our services.
• Whenever you use our services, also by visiting this website, you agree to these terms.

You’re also agreeing to stick to our:

• Privacy policy

• Cookies policy

Read those too below on this page!

IMPORTANT THINGS FIRST

Are you below the age of 18 years? Click away please. Close and don't come back before you're 18. We only conduct business with adults that are responsible themselves for what they do.

Are you here in the capacity of a private individual? Click away please. Close. Private individuals aren't allowed access to services nor content.

We only do business with independent business owners, people that act for: a company, an organisation, a non-profit-association, a school, or a government instance. By using services or content you agree and confirm that you are adult and that you are doing this in professional capacity.

What’s this about "services" and "content"?

a. Services

Let's understand:

Anything digital offered. Such as by example:

Websites
Apps

Podcasts

RSS feeds

Blogs

Vlogs

Streaming

Webinars

b. Content

Anything that’s available through those services. Including:

ebooks, articles, opinions, ...

Text

Audio

Video

Images

Games

Software

Technical stuff such as by example metadata and open-source code

When other terms apply

a. When you use services provided by someone else

When you use someone else's services or products, like an app from another company, they will have terms for using them.

b. When you use services where we tell you they apply

Like when you enter a competition. If there are extra terms, we’ll always let you know.

Terms for using our services and content

A few rules to stop you (and us) getting in trouble.

These apply to our services and content.

a. Don’t mess with our services

What do we mean by that? This sort of thing:

Hacking them

Trying to get around our content security technology (software that stops people copying our content)

Accessing content that you aren’t allowed to, or helping others do the same.
Refusing to remove content, games or apps from your device when we ask you to. This might happen when we take down services. Which we can do at any time, without notice.

b. Don’t harm or offend other people...

...while using our services or content. That means:

Don’t damage our reputation by associating us with sexism or racism, for instance

Don’t get us sued – by defaming (damaging the reputation of) someone, say, or commenting on an active lawsuit

Don’t harass or upset people

Don’t post or upload anything offensive or obscene

Don't discriminate

Don't be racist

Don't gossip

c. Play it safe

When you watch video content, or read content, or even use an app, be aware of your surroundings and be safe.

d. Don’t pretend to be one of our brands.

Don't pretend to be:

Tom Commeine

Firma Tom Commeine

FTC

businessdevelopment.be™

Lourense®, lourense.com, lourense.eu

freepos.be™

tomcommeine.com

commeine.com

commeine.be

That includes:

Recreating a service or copying the look of a service

Using our brands, trade marks or logos without our permission

Using or mentioning our content in press releases and other marketing bumph

Making money from our content or services. You can’t charge people to watch our video's or resell our ebooks without permission for example.

Sharing our content as if it's your own.

Metadata

a. For people

You’re not allowed to pluck metadata from our content.

b. For business

You're not allowed to pluck metadata from our content.

Your account

a. Registering for an account

You need an account to use some of our services, like personal recommendations and notifications.

b. Keep it safe.

To keep your account safe:

Don't tell anyone your username or password

Don't give us false information

Don't try to log in as someone else

Don't try to bypass our security measures

Don't create more than one account

Don't create an account for someone else.

And be sure to keep your details up-to-date.

c. What we do with your information

The data you send us when you register, fill in web forms or use our services helps us to:

Provide you with services, recommendations, notifications and other features

Improve our existing services and come up with new ones.

Read more on how we use your personal data in our privacy and cookies policy.

d. Changing settings and deleting your account

Find out how to tinker with or delete your account in our privacy and cookies policy.

Mishaps

We take great care to make our content and services the best they can be. So if something does go wrong, we are responsible only if the Belgian law is stating our responsability clearly.

Otherwise, we’re not liable for anything that happens if:

... You rely on advice, data, commentary, opinions or any other content

... There are errors, omissions, interruptions, delays, bugs or viruses

... We turn off or remove content, services, external links or creations
... The thing that happens couldn’t reasonably have been foreseen

... The thing that happens wouldn’t usually result from the mishap

... You and we hadn’t agreed that this thing would probably happen in the event of a mishap.

... This applies to sites we link to as well as our content and services.

Speaking of which…

External links

We sometimes link to services and content that aren't ours and we don't manage nor control.
And we sometimes put our services on them – when you connect with us on social media, for example.

A few things to bear in mind:

a. We don’t endorse the sites we link to.

b. We’re not responsible for their content or liable for anything that happens to you if you use them.

c. If you or anyone else shares something containing a link, we’re not responsible for anything on the site it links to.

d. External sites usually have their own terms of use. Read them and apply them.

Services and Content against payment.

a. For certain services and certain content it is possible that you need to pay in order to use them or to have access.

b. Sometimes it's a one time amount, sometimes it's a subscription with a fee per use or a fee per month, sometimes a combination. In every case this will be specified clearly to you so that you are aware before you order, buy, purchase, subscribe.

c. Let it be clear: No payment = No service = No content.
For example, when you subscribe to a service with a monthly subscription fee, that is processed automaticaly via de payment service provider, in a way you've initialy choosen, and after certain time, you for example at the date of payment don't have sufficient funds on that account and the payment doesn't work, then the service will cease to work.
Don't start nagging, complaining, or misbehave because of this, it's your responsibility to make payments can get processed as agreed on at subscription according to the choice you have made at that time. Ofcourse you can send a friendly email to the mentioned support address for the specific service or call and we'll see to solve it as fast as possible when you at your side make sure you pay.

Final stuff

A quick recap, a few extra legal bits and we’re done:

a. If you use a service on behalf of a business, that business agrees to these terms. So your business has to stick to these terms if you use a service...

substantially to do your job – as an employee, contractor or consultant

for commercial purposes – to make a profit or

for educational, non-profit, charitable or government uses.

b. As we said earlier, read these terms before using our services. When you use our services and content, you’re agreeing automatically to:

These terms of use

Our privacy and cookies policy

Any other terms we’ve let you know about.

And those things replace all previous agreements between you and us about using our services or content.

c. This is a contract between you and us. No one else has any rights to enforce its terms.

d. Belgian law governs these terms, and only Belgian courts can make judgments about them. More over, using our services is subject to an agreement to resolve disputes via Arbitrage.

"As a mutual guarantee and commitment for a fast settlement of controversies through arbitration, the RAAD VOOR ARBITRAGE V.Z.W. is charged with the appointment of arbitrators

who will be authorized to settle for good any controversy arising form the current document as to the interpretation, the execution or the dissolution, in conformity with its

regulations for operation that can be obtained free of charge, at the RAAD VOOR ARBITRAGE V.Z.W., Leuvensesteenweg 613 in 1930 ZAVENTEM (Tel. 02/757.98.46 , Fax

02/757.98.48 email info@raadvoorarbitrage.be). This clause replaces all authority clauses contrary to it. "

You will also see embedded ‘share’ buttons on our web pages; these enable users to easily share content with their friends through a number of popular social networks.
When you click on one of these buttons, a cookie may be set by the service you have chosen to share content through.
Again, we do not control the dissemination of these cookies. If you continue without changing your settings, we'll assume that you are happy to receive all cookies.
However, you can change your cookie settings at any time.

13. Private Browsing

Private browsing has been around in one form or another since 2005, but it took some time for every browser to get behind it.
Now, no matter what browser you use, you can surf the internet without leaving behind a local trail of history, passwords, cookies, and other assorted bits of information.

Private browsing is useful for covering your tracks (or rather, preventing any tracks from being made in the first place), among other things.
It isn’t infallible, however, and while it will prevent information from being stored on your computer, it won’t prevent your employer, Internet service provider, websites you visit, or the NSA for that matter, from collecting any information you transmit beyond your computer.

Every browser has their own name for private browsing, and while accessing it is accomplished in practically the same way, there can be subtle differences from product to product.

When this appeals to you, read then certainly everything about it in the settings and information pages in your browser on this topic. You are and remain the first responsable person for your own privacy.

More information here:

https://www.howtogeek.com/269265/how-to-enable-private-browsing-on-any-web-browser/

14. Apps, TVs and other Media Devices

When you download or use our services or apps on your mobile device or TV, information may be accessed from or stored to your device.
Most often this is used in a similar way to a web browser cookie, such as by enabling the app to ‘remember’ you or provide you with the content you have requested. Let's be honest with eachother, you'd find it most annoying if you'd have to enter every time over and again all your authentication data in the app before you can use it.
Your web browser or device may also provide us with information about your device, such as a device identifier or IP address.

COOKIES POLICY

a) What is a Cookie?

A cookie is a small amount of data, which often includes a unique identifier that is sent to your computer, tablet or mobile phone (all referred to here as a "device") web browser from a website's computer and is stored on your device's hard drive. Each website can send its own cookie to your web browser if your browser's preferences allow it. Many websites do this whenever a user visits their website in order to track online traffic flows. Similar technologies are also often used within emails to understand whether the email has been read or if any links have been clicked. If you continue without changing your settings, we’ll assume that you are happy to receive all cookies. However, you can change your cookie setting at any time.

On our websites, cookies record information about your online preferences and allow us to tailor our websites, services and content to your interests.

During the course of any visit to our websites, services, content, the pages you see, along with a cookie, are downloaded to your device. Many websites do this, because cookies enable website publishers to do useful things like find out whether the device (and probably its user) has visited the website before. This is done on a repeat visit by checking to see, and finding, the cookie left there on the last visit.

b) How do we use cookies?

Information supplied by cookies can help us to understand the profile of our visitors and help us to provide you with a better user experience.
It also helps us recognise when you are signed in to your account and to provide a more personalised experience.
For example, if on a previous visit you went to our education pages, we might find this out from your cookie and highlight educational information on your second and subsequent visits.
This type of information is used to help improve the services it provides to its users.
Certain areas of websites may use cookies for a specific reason - for example, to help an online application work effectively on your device.

Additionally, cookies are used to serve some targeted advertising.

c) Third party cookies in embedded content on pages

Please note that during your visits to our websites you may notice some cookies that are not related to us or our contractors.

To support our communication, we sometimes embed content from social media and other third party websites. These may include YouTube, Salesmanago, Twitter, Facebook, Soundcloud, Vine, Instagram, Pinterest, Flickr, and many other ... .
As a result, when you visit a page containing such content, you may be presented with cookies from these websites and these third party cookies may track your use of our website.
As we do not control the dissemination of these cookies, you should check the relevant third party's website for more information.

If you continue without changing your settings, we'll assume that you are happy to receive all cookies on our webpages. However, you can find out about changing your cookie settings here.

Where we embed content from social media and other third party websites, some websites may use Google Analytics™ to collect data about user behaviour for their own purposes.

As we do not control this, for more information see Google Analytics site ‘How Google Uses Data'.

e) Other information collected from web browsers

Your web browser may also provide us with information about your device, such as an IP address and details about the browser that you are using.

Where requesting local events, local news, or even local weather, it may be possible for you to choose to provide us with access to your device’s location.
